We help our business customers (“Customers”) by providing marketing services (human and automated), including CMO services, responding to online reviews, responding to service requests, generating and responding to leads, and otherwise providing marketing services (collectively, our “Services”). This Privacy Policy sets out how we collect, use, process, store, and disclose personal information in providing the Services.

Website Visitors and Customer Information:

Free Agency collects various information on our website visitors and Customers, including:

  • Employment information including name, title company email, company name, company website URL.
  • Correspondence with us, which may include any personal information provided during an email or chat correspondence with our customer service or sales team.
  • Billing and administrative finance information.

Our Customer’s End Client Information:

When our Customers use our Services, they may enable Free Agency to process various types of personal information on their End Clients. Below, we provide a list of the commonly processed personal information of End Clients. Please note, the below list is not exhaustive of all personal information, and is intended to serve as a sample set.

  • A list of existing clients’ business information in order to identify prospective similar clients.
  • Contact information for clients such as name, email address, company, and phone number.
  • Information shared in email, chat, phone calls or SMS correspondence between prospective or existing Clients and Customers.
  • Information provided in service requests sent to Customers or ads in search of services provided by Customers.
  • Information provided in reviews of our Customer’s services..
  • Payment information used for Customer billing, and billing activities.

2. HOW WE USE PERSONAL INFORMATION

Subject to the terms of our client agreements, we may use personal information for the following purposes:

  • To provide our Services, including chat, SMS, and telephone correspondence. Free Agency operates exclusively on behalf of our Customers, and does not use Customer personal information for its own benefit or to assist any other Customers.
  • To help us communicate with you through our email updates.
  • To respond to your inquiries and provide customer support..
  • To improve our products and Services, including training our artificial intelligence models.
  • To authenticate, verify, or otherwise ensure compliance with Customer written instructions or to mitigate the risk of fraud.
  • For payment processing.
  • For marketing and advertising, including generating and responding to potential End Clients for our Customers.
  • For any legal purpose necessary, including IP protection, or if Free Agency is required to process information as a result of a court order or other legal or regulatory proceeding.
  • Otherwise, with your consent.

We may use aggregated or anonymous information to ensure our Services are serving their intended purposes and for product improvements.

3. HOW WE DISCLOSE PERSONAL INFORMATION

Our Services provide Customers with the ability to synchronize certain external software or data applications with Free Agency, which may include the transfer of personal information. Some of the types of software, services and applications that support Free Agency are:

  • Customer Support, including chat or SMS functionality.
  • Customer Relationship Management, including contact management and billing.
  • Call Centers.
  • Email and SMS Communications Service Providers.

Subject to client agreements, we may disclose Customers information in order to:

  • Protect the legal rights of our company, our employees, our agents, and our affiliates.
  • Protect the safety and security of those who access and use our Services.
  • Detect and protect against fraud.
  • Comply with law or legal process.
  • Complete a legal transaction related to the sale of our business or any assets.

Free Agency may share aggregate or anonymous information for any purpose. This means that the information we share does not identify specific individuals, or is combined with other data to protect your privacy.

4. PRIVACY CHOICES

You may exercise the following choices with our use of your personal information:

  • Access the personal information we maintain about you.
  • Delete the personal information we maintain about you.
  • Correct inaccurate personal information we maintain about you
  • Opt out of certain uses of your personal information, notably:
    • Marketing Emails: To opt out of marketing e-mail communications, you may click the ‘unsubscribe’ link in the marketing emails.
    • Marketing Text Messages: To opt out of marketing text messages, you must reply STOP to the text message. You agree that texting ‘STOP’ in response to our text message is the only reasonable method of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than ‘STOP’ or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.

If you are a current or former employee of one of our enterprise Customers, and you would like to fulfill your rights to the personal information we maintain about you on behalf of our Customer, please contact a representative of that Customer rather than email us with your request. We cannot provide personal information about a specific individual on behalf of a customer without their express written instructions.

5. USE OF COOKIES AND TRACKING TECHNOLOGIES

Like many companies, we use cookies and similar technologies (such as clear gifs, web beacons, tags, and similar technologies) to collect information about your browsing activities, your interactions with websites and our Services, and to serve tailored ads and for the purposes described in this Privacy Policy. There are a number of ways to opt out of having your online activity and device data collected through these services, which we summarize below:

If you use a shared public computer, do not opt to have your login ID or password remembered and be sure to log out of your account when you finish.

We will retain Customer personal information according to the terms of our written agreements.

8. U.S. STATE-SPECIFIC NOTICE

Some U.S. states have enacted comprehensive privacy laws. The California Consumer Privacy Act, as amended by the California Privacy Rights Act or “CPRA” (collectively, the “CCPA”), the Virginia Consumer Data Protection Act (“VCDPA”), the Colorado Privacy Act (“CPA”), the Connecticut Data Privacy Act (“CTDPA”), the Utah Consumer Privacy Act (“UCPA”), the Oregon Consumer Privacy Act (“OCPA”), the Texas Data Privacy and Security Act (“TDPSA”), and the Montana Consumer Data Privacy Act (“MTCDPA”) create additional privacy obligations for businesses and provide their residents with additional privacy rights.

Free Agency operates as a ‘Controller’ (and a ‘Business’ under the CCPA) with respect to processing our Customer information and as a ‘Processor’ (and a ‘Service Provider’ under the CCPA) with respect to End Client information.

9. CHILDREN’S PRIVACY

We do not intentionally collect any personal information from children under the age of 16. If you believe we have obtained personal information associated with children under the age of 16, please contact us at [email protected] and we will delete it.

10. THIRD-PARTY LINKS

The Services may contain links to other sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our sites and to read the privacy statements of any other site that collects personally identifiable information.

We may update this Privacy Policy from time to time as we update or expand our Services. If we make material changes, we will post the updated Privacy Policy on this page with a ‘Last Updated’ effective date of the revisions.
